| “I hereby affirm that I own the copyright in the photo or
digital image provided to the Company, (“Company”) or
I am authorized by the owner of the copyright photo or digital
image to make and use the photo or digital image for any purpose and
agree to indemnify the Company for all costs and expenses in the event
a third party claim is asserted with respect to the ownership rights
in the photo or digital image. Once the photo or digital image is
altered by the Company, it becomes property of the Company. I agree
to hold Company harmless for any damages or loss to the photos or
digital image. When placing an order I agree to have PhotoCrazed adjust my order on my behalf if I selected the wrong amount of subjects to properly reflect the posted subject fees. Images on the site may not be accurate. Actual frame received may vary in width, size and color. Art received may vary in color from images on the website. Additional charges to be incurred if, after work has started, a different photograph or design is chosen. Work carried out, whether preliminary, experimentally or otherwise, at my request, to be charged accordingly. If I cancel the order after work has been commenced, but not after being printed out, I agree to pay all costs incurred up to the time of cancellation. I hereby agree to additional charges incurred by: - $42 for photo change, if the designers have started working on the original photo - $30 (unless otherwise specified) per additional subject - $55 for switching design, if the designers have started working on the original design - $42 for canceling, if the designers have started working on the order but it has not been printed out 7.00% sales tax to be added to orders shipped to New Jersey. Delivery charges will be covered by Me, Photocrazed.com cannot guarantee delivery times or dates due to circumstances beyond their control. I hereby release Company, and any of its associated or affiliated companies, their directors, officers, agents, employees and customers, and appointed advertising agencies, their directors, officers, agents and employees from all claims of every kind related to the alteration of the photos or digital images. I further consent to the reproduction and/or authorization by Company, to reproduce and use said photographs for use in all domestic and foreign markets. Further, I understand that others, with or without my consent, may use and/or reproduce such photographs. In addition, by participating, I am agreeing to the use of my photo or likeness for publicity, marketing, and sale purposes with no financial or other type of compensation. I hereby waive any right to inspect or approve any publicity materials produced. These publicity materials may be used at the discretion of the Company, and any of its associated or affiliated companies, their directors, officers, agents, employees and customers, and appointed advertising agencies, their directors, officers, agents and employees.”
